Xshell for HarmonyOS (Open Beta)
This End User License Agreement (“Agreement”) is between you and NetSarang Computer, Inc. (“NetSarang”, “we”, “us”). It applies to Xshell for HarmonyOS (“the Software”), distributed through Huawei AppGallery, and to your use of it.
Please read this Agreement before you use the Software. By installing or using the Software, you agree to this Agreement. If you do not agree, or do not fully understand this Agreement, do not install or use the Software, and uninstall it if it is already installed.
Huawei is not a party to this Agreement. Your download and installation of the Software through Huawei AppGallery are also subject to Huawei’s own terms.
The Software is an Open Beta. It is a pre-release version that is still in development. It may contain bugs, may behave differently from the Windows version of Xshell, and may cause loss of the data it stores, such as saved sessions and settings. Features may be added, changed or removed during the Open Beta. Please keep your own backup of anything important.
The Software is currently available only for HarmonyOS PC devices.
NetSarang grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on HarmonyOS devices that you own or control, for personal or commercial purposes, in accordance with this Agreement.
This Agreement gives you a license to use the Software. It does not transfer ownership of the Software or of any intellectual property in it.
If you accept this Agreement on behalf of an organization, you represent and warrant that you have the authority to bind that organization to this Agreement.
Free of charge. The Software is currently provided free of charge. It contains no in-app purchases, subscriptions or advertising.
Commercial use. You may currently use the Software for commercial purposes, including at work.
These may change. NetSarang may in the future charge for the Software or for some of its features, introduce a paid license or subscription, or change the conditions for commercial use. If we do:

You also may not use the Software to infringe the intellectual property or other rights of others. To the extent permitted by applicable law, you are responsible for any claims by third parties arising from your breach of this Agreement.
The Software, including its images, text and other content, is owned by NetSarang or its licensors and is protected by the copyright laws of the Republic of Korea and by international treaties. Xshell® is a registered trademark of NetSarang Computer, Inc.
The Software includes open-source components that are licensed under their own terms. Those terms, not this Agreement, apply to those components, and nothing in this Agreement restricts your rights under them. The list of these components, their license texts, and information on obtaining source code where a license requires it are available on the open source notices page.
How the Software handles your information is described in the Xshell for HarmonyOS Privacy Statement. In short: the Software does not collect your personal information and does not send it to NetSarang. The information you enter, such as host names, user names and any passwords or keys you choose to save, is stored only on your device and is used only to make the connections you start.
You are responsible for the servers and devices you connect to, for having permission to access them, and for keeping your own credentials safe. You are also responsible for the commands you run and the actions you take through the Software on the systems you connect to, including the consequences of your own input errors.
Updates are delivered through Huawei AppGallery. NetSarang may end the Open Beta at any time, or replace it with a release version. The terms that apply to a release version will be provided with that version.
You may stop using the Software at any time by uninstalling it. NetSarang may end your license if you breach this Agreement, or when the Open Beta ends. When your license ends, you must stop using the Software and uninstall it.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. Because the Software is a pre-release beta, NetSarang does not warrant that it will be error-free or uninterrupted, or that it will not lose data. To the extent permitted by applicable law, NetSarang is not responsible for failures or interruptions caused by network or communication faults, the servers or devices you connect to, malware or attacks, or other events beyond its reasonable control.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NETSARANG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR BUSINESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SOFTWARE.
Nothing in this Agreement limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for intentional misconduct or gross negligence, or your statutory rights as a consumer.
The Software is a professional tool for system and network administration and is not directed at children. If you are under the age of majority where you live, you may use the Software only with the consent of a parent or legal guardian.
NetSarang may update this Agreement. We will announce material changes in advance, in the Software, on its AppGallery page or on our website. Changes required for security, legal or regulatory reasons may take effect without that advance notice, but we will notify you as soon as possible. If you continue to use the Software after the changes take effect, the updated Agreement applies. If you do not agree, stop using the Software and uninstall it.
This Agreement is governed by the laws of the Republic of Korea, without prejudice to any mandatory consumer protection laws of the country or region where you live.
